Applicant Tracking (ATS) software: a practical buyer guide for US teams

Job posts, pipelines, and hiring team scorecards. Here is what to look for, what to ask, and what to avoid, written for HR leaders from startup to enterprise.

What applicant tracking (ats) software does

An applicant tracking system (ATS) manages hiring from job request to signed offer. It posts jobs to your careers page and job boards, collects applications, moves candidates through stages, schedules interviews, gathers feedback, and produces the offer letter. A good ATS also keeps the records you need to show your hiring process is fair and consistent.

The biggest predictor of ATS success is not features. It is whether your hiring managers will actually use it.

Signs you are ready for it

  • Candidates fall through the cracks between email, LinkedIn, and spreadsheets.
  • Hiring managers leave feedback in chat threads or not at all.
  • You cannot answer 'how long does it take us to hire an engineer?' with real data.
  • Candidates complain about slow responses or never hearing back.
  • You need EEO data collection or OFCCP-ready records as a federal contractor.

Must-have features

Structured hiring

Interview plans, question kits, and scorecards tied to the skills you are hiring for.

Job distribution

Posting to your careers page and major job boards from one place.

Hiring manager experience

Feedback from Slack, Teams, email, or a phone without a separate login every time.

Interview scheduling

Calendar integration and candidate self-scheduling.

Offer management

Templated offers with approval routing and e-signature.

Compliance data

Voluntary EEO self-identification, kept separate from hiring decisions, plus audit-ready reports.

US compliance to keep in mind

Federal anti-discrimination law applies at every stage of hiring. Employers with 100 or more employees file the EEO-1 report, and federal contractors have additional record-keeping duties. Many states and cities restrict asking about salary history or criminal history early in the process. If you use AI to screen or rank candidates, New York City requires a bias audit and candidate notices for automated employment decision tools, and other jurisdictions are developing similar rules. Make sure your ATS lets you control what is asked, when, and who sees it.

This guide is general information, not legal advice. Laws change and differ by state. Confirm details with the agency linked below or with employment counsel.

How pricing usually works

ATS pricing varies widely. Some vendors charge per open job, some per employee in your company, and some a flat annual fee by company size. Job board premium postings, sourcing tools, and AI features are often add-ons.

AI features worth asking about

AI in recruiting is the most regulated AI in HR. Common features include job description drafting, resume parsing, candidate matching, and interview note summaries. Ask whether candidate ranking can be turned off, whether the vendor publishes bias audit results, and whether you can explain to a candidate how a decision was made.

Questions to ask in every demo

  1. Show me how a hiring manager gives feedback without logging into the ATS.
  2. How do you keep EEO self-identification data away from interviewers?
  3. If we use your AI matching in New York City, what audit and notice support do you provide?
  4. What reports show time to hire and pass-through rates by stage?
  5. How does the offer letter get its salary range in pay transparency states?

Red flags during evaluation

  • AI ranking is on by default and cannot be fully disabled.
  • Hiring managers need a paid seat to leave feedback.
  • No candidate data retention or deletion settings.
  • The careers page cannot be styled to match your brand.

Frequently asked questions

Do small companies need an ATS?
If you hire more than a handful of people a year, yes. Free and low-cost options exist, and even a light ATS improves candidate experience and keeps your records consistent.
Should our ATS and HRIS be from the same vendor?
It reduces sync problems, but a best-in-class ATS with a solid integration is also common. The key is that new hire data flows into your HRIS without re-typing.
Is it legal to use AI to screen resumes?
Generally yes, but anti-discrimination law still applies to the outcome, and some places, like New York City, add audit and notice requirements. Review the vendor's documentation with counsel.
